Attorney General Lawrence Wasden has announced a Canyon County man was sentenced Wednesday, February 27, for attempted grand theft.

37-year-old Erubiel R. Avila of Caldwell pleaded guilty in December.

Third District Court Judge Christopher Nye ordered a withheld judgment and placed Avila on three years probation. The judge also ordered 180 days of discretionary jail time and restitution in the amount of $481 to the Idaho Department of Insurance and $187 to Progressive Insurance.

A Department of Insurance investigation revealed that on June 20, 2015, a member of Avila’s family was driving a truck owned by Mr. Avila when she was cited for causing an accident and failing to provide proof of insurance. Mr. Avila later attempted to add the vehicle involved in the wreck to his Progressive policy by providing a false purchase date for the truck. The other driver filed a claim against Avila’s policy but was denied when Progressive determined Avila’s vehicle was not insured at the time of the accident.

Deputy Attorneys General Nicole Schafer and Jessica Cafferty in the Attorney General’s Special Prosecutions Unit prosecuted the case.
